Xi Hong v . People's Daily : an early defamation case 62. With the advent of the Internet age, online defamation is becoming the latest trend in torts involving damage to reputation. Online defamation refers to the act of defaming others through the use of the Internet; the defamatory content can be text, pictures, sound, animation, and other forms of digitalized materials that can be transmitted in cyberspace. With regard to the new problems raised by online defamation, the NPC's Decision on Safeguarding Internet Security stipulates that, in order to protect the personal and property rights of individuals and organizations, anyone who makes use of the Internet to insult or to slander other people with fabricated stories shall bear criminal responsibility if his act constitutes a crime. The Decision also provides that, to maintain the order of the socialist market economy and social administration, anyone who make use of the Internet to damage other people's business reputation and product reputation shall be investigated for criminal responsibility if his act constitutes a criminal offense. This law thus provides legal support and guidelines for Chinese courts to criminalize online defamation in serious circumstances.
